Access to information and national security: the Tshwane principles

The rights to access to information and to the truth are fundamental rights recognized by the Inter-American System of Human Rights for more than a decade. According to consistent rulings by the Commission and the Inter-American Court, state information should in principal be public.

The classification of information should respond to the principles of strict necessity, legality and proportionality and the motives for said classification should be clearly detailed in an existing law.

Historically, one of the principal motives cited by States for the classification of information has been national security. The Tshwane Principles collect international case law and best practices for the implementation of laws and policies on access to information related to national security that are compatible with human rights.

The CELE project, in partnership with the Open Society Justice Initiative, seeks to bring the issue of access to information back to the regional agenda, promoting the adoption and incorporation of the Tshwane Principles to the work of governmental and non-governmental organizations and at the regional and local level. With this in mind, CELE will work with civil society organizations and other human rights organizations, both governmental and non-governmental, and will focus its efforts, principally, on the promotion of these principles within the Inter-American Human Rights System and other regional bodies working on this issue.
